AN ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 886 (Section 12.08.010
of the Port Orchard Municipal Code)
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. That Section 1 of Ordinance No. 886
(Section 12.08.010 of the Port Orchard Municipal Code is
amended to read as follows:
12.08.010 Compensation to city required.
Before any ordinance to vacate any street or alley, or
any part thereof, shall become effective, the owners of
property abutting upon the street or alley, or part thereof
so vacated, shall compensate the city in an amount equal to
the appraised value of the area so vacated, as determined
by an independent and experienced real estate appraiser to
be retained by the petitioners at their expense; provided,
however, that in cases where a portion of any street or
alley, upon being vacated, becomes the property of the City
of Port Orchard or any other municipal corporation, the city
council may grant the vacation in favor of the municipal
corporation without compensation. (Ord. 886 §1, 1971:
